Who you are contracting with
Trips are operated by Amawele Enterprises (Pty) Ltd (registration number 2023/511794/07), trading as Atlantic Drift Fishing Charters, from Hout Bay Harbour, Hout Bay, Western Cape, South Africa.
Registered office: 74 Sandpiper Crescent, Table View, Western Cape, 7441. Correspondence about a booking should go to garreth@theatlanticdrift.co.za rather than to the registered office.
Booking and payment
No deposit is required. A booking is confirmed when it is acknowledged in writing, and the trip is payable on the day. Before departure you may be asked to authorise a card against the cancellation fee set out in the cancellation policy.
Card details are held against the cancellation terms only and are charged solely in the circumstances set out in the cancellation policy.
Published rates are per the rate card on this site at the time of booking. Rates may change for future bookings; a confirmed booking is held at the rate agreed.
The skipper’s authority
The skipper has sole and final authority on all matters of safety, route, duration and whether a trip runs at all. That authority extends to ending a trip early, changing the destination, and refusing to carry any person the skipper judges unfit to travel.
Decisions taken on safety grounds are not refundable beyond the weather policy set out separately.
Your responsibilities
By boarding you agree that:
- You have disclosed any medical condition that may be affected by a day at sea, including heart conditions, pregnancy, epilepsy and recent surgery.
- You will follow the skipper’s and crew’s instructions at all times.
- You will not board under the influence of alcohol or any substance that impairs judgement.
- You are responsible for your own possessions on board.
- You will comply with all applicable fishing regulations, bag limits and closed seasons.
Catch
Catch is retained within the legal bag limits applicable to the species and season. Fish over the limit, out of season or of a protected species are returned to the water. No trip carries any guarantee of catch.
Liability
Nothing in these terms excludes liability that cannot lawfully be excluded, including under the Consumer Protection Act 68 of 2008.
Governing law
These terms are governed by the laws of the Republic of South Africa and are subject to the jurisdiction of the South African courts.
